An invention is patentable if it is novel, involves an inventive step (not obvious to a person skilled in the field), and is capable of industrial application. Software patents and business methods have specific restrictions in India — our experts advise on eligibility before filing.

A patent in India is valid for 20 years from the filing date of the application, subject to payment of annual renewal fees. Failure to pay renewal fees leads to lapse of the patent.

File a provisional application if you have a working concept but aren't ready to write the complete specification. It's cheaper and secures your priority date immediately. You then have 12 months to file the complete application. If your invention is fully developed, you can file complete directly.
